Speaking exclusively to India Today Group the Solicitor General of India Mohan Parasaran said that he believes that Lord Ram walked the Sethu and hence recused himself from the case.
"I come from that area and I don't want people to hold it against me. I'm privy to my belief. It is guaranteed in the Constitution so I felt that it should be made clear at the earliest to the government," said soft speaking Mohan Parasaran.
He also said that since his father was also fighting the case for the petitioners against the Sethusamudram project, he also wanted to avoid conflict of interest. Mohan Parasaran also said that the Niyamgiri case too have a precedence on this issue as will of the people was respected by the Court in the bauxaite rich area. "This will have resonance of Ayodhya where ultimately locals are being involved by the government," said Mohan Parasaran.
In the Niyamgiri case, the court ultimately allowed people to decide whether the mountain could be mined or not. The social activists had received support from Congress Vice President Rahul Gandhi who visited the area.
Sources said that by this personal act Parasaran is also sending a signal to the government that it is walking on thin ice. Parasaran also added that NASA had already demonstrated that the bridge exists. "There are environmental issues also which I hope government will also take care of," said Mohan Parasaran.
Sethusamudram was revived by the CCPA who felt that the matter could be pursued again. Though the project is sub judice, the UPA showed its commitment towards this project by rejecting the environmental reports and on ground that it would stimulate economic activity. DMK is a very strong supporter of this project and from time to time has been raising this issue within the government to expedite the matter in the Supreme Court. BJP is strictly opposed to the project.
Parasaran insists that it was a personal decision but his act of removing himself from the case will sent shock waves in the government as in India no main stream political party can afford to be branded as atheist.
However, the judiciary is currently divided on Parasaran's move. "There is no bar in law. Sometimes your values clash with your client's interests and one of the parties has to give in. Often it is the lawyer. When the emergency was declared Nani Palkhivala retured Indira Gandhi's election appeal despite the fact that he was her counsel," says D Abhinav Rao, advocate, Supreme Court.

Chennai : DMK president M. Karunanidhi on Tuesday took exception to the remarks of Solicitor-General Mohan Parasaran, who had spoken about his belief in Lord Ram while declining to appear further for the government in a case related to the Sethusamudram ship canal project in the Supreme Court, as it involved destruction of ‘Ram Setu.’
“I don’t think it is correct on the part of Mr. Mohan Parasaran to speak like a communalist, at a time when the Centre has come forward to implement the project and informed the Supreme Court about it,” he told reporters here.
In remarks published online, Mr. Parasaran had said he did not want people to hold it against him. “I am privy to my belief. It is guaranteed in the Constitution, so I felt that it should be made clear at the earliest to the government,” he said.
He also said since his father, K. Parasaran, was appearing on behalf of the petitioners against the Sethusamudram project, he was recusing himself to avoid conflict of interest.
Mr. Karunanidhi said Mr Parasaran was the Solicitor General of a secular government and it is not clear whether he had identified himself as a communalist. “He has not quit his post, but only relieved himself from appearance in the Sethusamudram case. It is a project that will bring benefit to Tamil Nadu and its people,” he said.
